1. PURPOSE OF THIS PRIVACY NOTICE

This privacy notice describes how OtE Productions will collect and use the personal information that you provide to us when you download, access and/or play our Game, contact us via the Game, or otherwise interact with us via the Game. 

It is important that you read this privacy notice together with any other privacy notice that we or any related companies of ours have provided or may provide to you when we are collecting or processing personal information about you in other contexts, when we enter into funding agreements with you or when you visit our website. This privacy notice supplements any other such notices and does not replace them.

In this notice, references to “we” or “us” are to OtE Productions and references to the GDPR are to the General Data Protection Regulation (EU 2016/679).

2. WHO WE ARE

OtE Productions Limited (Company No. 09660075) is the controller in respect of personal information processed about you, as described in this privacy notice.  

Our registered office is at 25 Ives Street, London, SW3 2ND.

3. WHEN DO WE COLLECT PERSONAL INFORMATION ABOUT YOU

We will collect personal information about you: 

  1. when you download the Game from an app store/electronic marketplace;

  2. when you access and/or play the Game;

  3. when you make an enquiry, provide feedback, make a complaint, or otherwise contact us over the phone, by email or via the Game; and

  4. ‘follow’, ‘like’, post to or interact with our social media accounts, which may include, without limitation, Facebook, LinkedIn, Twitter and Instagram. 

  5. Our Services may contain links to websites or social media platforms. We are not responsible for the contents of the websites or social media platforms of other companies or for the practices of such companies regarding the collection of personal information.

4. WHAT PERSONAL INFORMATION DO WE USE

We may collect, store and otherwise process the following kinds of personal information about you:

  • when you make an enquiry, provide feedback, make a complaint, or otherwise contact us over the phone, by email or via the Game 

  • your full name and contact details, including email address, postal address or telephone number;

  • details of any correspondence that you send to us;

  • when you access and/or play the Game

Game usage data, including information about your interactions with and within the Game, such as your location, the date and time you accessed the Game, the amount of time you spend in the Game, the amount of time you spend on any given level within the Game;

technical data, including your geographical location, information about the device you use to access the Game (Device) (such as your hardware model, mobile network information, unique device identifiers);

In certain circumstances, we will receive information about you from third parties. For example: 

  1. we may receive personal information from the third party service provides we engage such as our Game developer, our Game publisher and IT support provider;

  2. Our games use third party plugins and services which may collect and process data about your use of our games. Data collected from these services is for analytics and marketing purposes in order for us to make improvements to the game-play features offered in our games.For more information about the third party services and the data they collect please visit their respective privacy policies: - Unity - Firebase - Singular

  3. we may from time to time ask you for your consent to collect other information from you or your Device. If we do this or something similar, we will tell you what information we would like to collect, why we need it and what we’ll use it for;

  4. we may use publicly available sources for instance to carry out identity and compliance checks; 

  5. we might also receive information about you from third parties if you have indicated to such third party that you would like to hear from us;

  6. we may receive some of the information that you submit to any third party website that you access via the Game (if any). Both we and the owner or operator of that third party website will be data controllers in respect of any such information.  

5. DATA COLLECTION

In order to collect some of the information set out in section 4, the Game uses certain authentication software to ensure that you get the most out of the Game. This software allows us to monitor Game traffic, improve the Game’s usability and to personalise the content of the Game for you. 

Our ability to track certain information may be disabled by you by changing the settings on your device. For more information about how to do this please consult the “Settings” section of your Device. Please note that if you do amend the privacy settings of your Device, you may not be able to use all of the features of the Game. 

6. HOW WE USE YOUR PERSONAL INFORMATION

We will use your personal information for a variety of purposes:

  1. to reply to any correspondence you have sent to us;

  2. to provide customer service to you in relation to your use of the Game, to deal with enquiries and complaints relating to the use of the Game and to notify you about any changes to the Game;

  3. to provide you with the services and information you have requested (for example, to grant you access to the Game); 

  4. to provide certain in-Game features;

  5. to monitor your use of our Game, and to administer, support, improve, optimise and develop the Game to improve the user experience, and to ensure that the content in the Game is presented in the most effective manner for you and your Device;

  6. to authenticate your access to our Game;

  7. for system administration purposes and for internal operations, including troubleshooting, data analysis, testing, research, statistical and survey purposes;

  8. to conduct marketing analysis to allow us to assess trends and the effectiveness of our advertising and marketing campaigns (including using your personal information to evaluate, analyse or predict certain personal aspects relating to you, such as your preferences, interests, and/or location);

  9. for security and fraud prevention, including to prevent cheating within the Game;

  10. to ensure that our Game is safe and secure; and

  11. to comply with our legal, contractual, ad regulatory obligations. 

7. LAWFUL GROUNDS

Under the GDPR, we are required to rely on one or more lawful grounds to collect and use the personal information that we have outlined above. We consider the grounds listed below to be relevant:

a)Legitimate Business Interests

We rely on this basis where applicable law allows us to collect and use personal information for our legitimate interests and the use of your personal information is fair, balanced and does not unduly impact your rights. It is necessary for us to understand our customers, promote our Game and effectively operate our company, provided in each case that this is done in a legitimate way which does not unduly affect your privacy and other rights. For example we will rely on this legal basis when we conduct certain analytics and research to improve and develop our Game.

b)Consent

We may obtain your consent to use your personal information in certain circumstances. For example, to send you email marketing by email (although we currently don’t do this with information you provide by playing the Game). We will ensure that when we obtain your consent you are free both to give it and to decline to give it. Additionally, you may always withdraw your consent at any time without any further detriment to you.

c) Performance Of A Contract With You

We rely on this basis where we are required to process your personal information in order to perform obligations to you under a contract. For example, if we were to offer in-app purchases via the Game and we need to use your contact details and payment information in order to process your order and deliver the relevant in-app purchase to you.

d) Compliance With Law

  1. We rely on this basis where we are subject to a legal obligation and need to use your personal information in order to comply with that obligation.

8. DO WE SHARE YOUR PERSONAL INFORMATION

We do not sell your personal information. However, we may disclose it to certain third parties in order to allow us to provide the Game to you, enforce our rights or to comply with legal or regulatory obligations. Such third parties include:

  1. our group of companies (i.e. our subsidiaries, our ultimate holding company and its subsidiaries, as defined in section 1159 of the UK Companies Act 2006);

  2. suppliers and service providers who we engage to process data on our behalf (such as, for example, Playstack Limited, the Game publisher or Quantum Shift Studios the Game Developer);

  3. prospective buyer of our business or assets in the event that we sell any of our business or assets; and

  4. regulators, government bodies, law enforcement agencies, and our legal and other professional advisors.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. 

9. INTERNATIONAL DATA TRANSFERS

Where your personal information is transferred, stored, and/or otherwise processed outside the UK or EU in a country which does not offer an equivalent standard of protection to the UK or EU, we will take all reasonable steps necessary to ensure that the recipient implements appropriate safeguards (such as relying on standard contractual clauses approved by the European Commission) designed to protect your personal information.

10. SECURING YOUR PERSONAL INFORMATION

We take appropriate technical and organisational precautions to prevent the loss, misuse or alteration of your personal information. We restrict access to those who have a need to know and we train staff in handling the information securely. We will store all the personal information you provide on secure servers. Unfortunately there is no such thing as perfect security in the online environment. As a result we cannot and do not guarantee the security of any information you transmit to us through or in connection with the Game. 

If you believe that your interaction with us is no longer secure (e.g. you consider that the security of any correspondence you might have with us has been compromised) please immediately notify us by contacting us at office@ontheedge.org.

11. YOUR RIGHTS AND PREFERENCES

Please note that we will honour your requests to exercise your rights to the extent possible and required under applicable law. Certain of these rights may only be available to you if you are located in the UK or the EU when you access or play the Game or otherwise engage with us in relation to the Game. 

You have the right to:

  1. Ask us for confirmation of what personal information we hold about you, and to request a copy of that information. If we are satisfied that you have a legal entitlement to see this personal information, and we are able to confirm your identity, we will provide you with this personal information.

  2. Withdraw your consent at any time if we have relied on consent as the lawful ground to use your personal information.

  3. Request that we delete the personal information we hold about you, as far as we are legally required to do so.

  4. Ask that we correct any personal information that we hold about you which you believe to be inaccurate.

  5. Object to the processing of your personal information where we: (i) process on the basis of the legitimate interests ground; (ii) use the personal information for direct marketing; or (iii) use the personal information for statistical purposes.

  6. Ask for the provision of your personal information in a machine-readable format to either yourself or a third party, provided that the personal information in question has been provided to us by you, and is being processed by us: (i) in reliance on your consent; or (ii) because it is necessary for the performance of a contract to which you are party; and in either instance, we are processing it using automated means.

  7. Ask for processing of your personal information to be restricted if there is disagreement about its accuracy or legitimate use.

Please note that you also have the right to lodge a complaint with your local data protection authority about how we use your personal information if you are located in the UK or the EU. In the UK, this is the Information Commissioner’s Office. Please always consider raising your concern with us first by contacting us using the contact details in section 15 below.

Cookies are small files, usually of letters and numbers, that are stored by your browser on your desktop computer or mobile device. If you want to learn more about what cookies are, or how to control or delete them, you can visit http://www.aboutcookies.org for detailed guidance. To provide our Games, we use ad identifiers, cookies and similar technologies. These technologies allow us to:

  1. recognise you and your Device;

  2. allow us to understand how you interact with our Game (for example, where we use cookies such as the Google Analytics cookie); 

  3. enable us and third parties to provide you with more customised services; and

  4. allow our Game to interact with a third party social network or platform (where you have chosen to allow such interaction).

  5. You can opt out of all our cookies (except the strictly necessary ones). Find out how to control and delete cookies in your browser. Please note that if you choose to adjust your preferences in order to prevent these technologies, you may find that our Game does not      function for you as we would like them to and that you cannot enjoy the full use of our Game.

13. Updating this privacy notice

We may update this privacy notice by posting a new version in the game. If we update this privacy notice in a way that significantly changes how we use your personal information, we will bring these changes to your attention where reasonably possible. Otherwise, we recommend that you periodically review this privacy notice to be aware of any other revisions.
